Mr. Moraru has contacted this office with a concern which seems to fall
within the jurisdiction of the Ministry of Environment & Energy.

I wish to inform you of this matter and of the Ombudsman's intention to
investigate; it may expedite the investigation if your Ministry is prepared to
give us its view. To allow you time to respond, we will postpone our
investigation until April 26, 1996.

By way of background, Mr. Moraru was enrolled as a student at Seneca
College in the Special Program entitled "Training for Immigrant
Professionals". On May 31, 1995 he signed a Placement Agreement with
the Ministry of Environment and Energy to work as a Systems Support
Officer from May 29, 1995 to June 30, 1995. At the completion of this
placement, he received a successful assessment notice from his supervisor.
He claims that he then signed an agreement for a permanent position
effective from July 10, 1995. This was to include an 8-week period
probation period. However, he was released from his job on September 1,
1995 on the grounds that his employment has been temporary. The
Ministry provided Mr. Moraru with a copy of a temporary contract as
proof. However, he denies him this was the agreement that he had signed.
As confirmation, Mr. Moraru points out that the space for his signature is
blank on the temporary agreement.

Briefly, it is Mr. Moraru's contention:

That the agreement which he signed on July 10, 1995
was for a permanent position and that the Ministry is
withholding this document. He therefore maintains that
the Ministry should re-hire him as a Systems Support
Officer.

We can assure you that we have not yet formed any opinion on this matter.

It may be necessary to forward a copy of your response to this letter to Mr.
Moraru to request comments. Unless you advise us that you prefer this not
be done, we will assume you have no objection.

It would assist us with our investigation if you would kindly provide in your
response the name of an appropriate member of your staff whom we may
contact, if necessary, for further information.

We hope that this matter will be resolved and thank you for your anticipated
cooperation.
