This appeal, by notice of appeal by the applicant, dated May 19, 1999, from the denial
of a legal aid certificate by the Area Director and upheld by the Area Committee at
Scarborough on May 13, 1999, comes to me by way of Section 30(2) of the Legal Aid
Services Act, 1998. The applicant applied for legal aid in order to pursue a Human
Rights complaint.

I have carefully considered the material in this application, including the
submissions of the applicant contained in his notice of appeal. I have concluded that the
Area Committee correctly determined that the issue in this case does not fall within the
priority guidelines of Legal Aid Ontario.

The applicant wishes to pursue a human rights complaint and has initiated a
complaint with the Ontario Human Rights Commission. No independent representation
is required for the applicant to pursue his complaint, as the Commission provides the
necessary representation. This is a matter which is outside the areas of civil litigation
which are covered by Legal Aid. Therefore, a legal aid certificate is not available.

Accordingly, I am not in a position to overrule the Area Committee.
