Pursuant to subsection 36(2) of the Human Rights Code, the Commission
has decided not to refer the subject matter of this complaint to the board of
inquiry for the following reasons:

1. There is insufficient evidence to indicate that the complainant was
subjected to unequal treatment or harassed in employment because
of race, colour or place of origin.

2. The evidence indicates that the complainant completed the full term
of his contractual employment and that he was not a probationary
employee in a classified or non-classified position.

For the above reasons, the Commission is of the view that the evidence in
this matter does not warrant referral to the board of inquiry.
